How Michigan treats accrued PTO

Michigan does not require PTO payout by statute. The payout obligation is governed by the employer's policy or employment contract. Michigan's Earned Sick Time Act does not require sick leave payout at separation. UPDATE 2025: Following Mothering Justice v. Attorney General (MI Supreme Court, July 2024), the Earned Sick Time Act was restored via HB 4002 (Public Act 2 of 2025). Large employers (11+) must provide up to 72 hours of earned sick time effective February 21, 2025. Small employers (≤10): 40 hours effective October 1, 2025. ESTA sick time does not require payout at separation.
