Does Nevada require PTO payout?
Not automatically. Nevada has no law forcing employers to pay out unused PTO, so it comes down to your written policy or contract. If the policy promises payout, that promise is enforceable as wages. The controlling authority is NRS 608.0197; NRS 608.020-050.

How Nevada treats accrued PTO
Nevada does not mandate PTO payout upon separation. Under NRS 608.0197, private employers with 50+ employees must provide paid leave, but this leave does not have to be paid out at termination. Payout is governed by employer policy. Employees must be allowed to carry over up to 40 hours of accrued paid leave per year.

Your other Nevada entitlements

- Paid sick leave
- Nevada has no state paid sick leave mandate, so sick time is whatever your employer offers, and it is separate from the vacation balance discussed above. Nevada has no state paid sick leave law. Check your employer's policy. Check your sick leave balance .
- Minimum wage
- The Nevada minimum wage is $12.00/hr , above the federal $7.25 (effective July 1, 2024). Your PTO payout is paid at your own rate of pay, not the minimum, but the minimum is the floor below which no hour may be paid. Nevada minimum wage details .
- Overtime
- Nevada pays overtime at 1.5x after 40 hours in a week , and after 8 hours in a single day . Unpaid overtime is often owed alongside unpaid PTO, so it is worth checking both before you sign anything. Calculate your overtime .
