Does New Jersey require PTO payout?
Not automatically. New Jersey has no law forcing employers to pay out unused PTO, so it comes down to your written policy or contract. If the policy promises payout, that promise is enforceable as wages. The controlling authority is N.J. Stat. § 34:11-4.4.

How New Jersey treats accrued PTO
New Jersey does not require PTO or vacation payout by statute. Whether PTO is paid out depends on the employer's policy. NJ Earned Sick Leave (under the NJ Paid Sick Leave Act) does not require payout at separation. If vacation is promised as part of compensation, it may be considered wages and must be paid.
