How Nebraska treats accrued PTO

Nebraska requires payout of all earned, unused vacation and PTO upon separation. The Nebraska Supreme Court has ruled that PTO — which may combine vacation, sick, and personal leave — is indistinguishable from vacation and must be paid out, regardless of company policy. Forfeiture policies are not enforceable. UPDATE 2025: Nebraska voters approved Initiative 436 (2024), creating the Healthy Families and Workplaces Act (amended by LB 415, signed June 5, 2025). Employers with 11+ employees must provide earned paid sick leave (1 hr per 30 hrs worked, up to 40-56 hrs/year) effective October 1, 2025. This standalone sick leave does not affect PTO payout requirements under § 48-1229.
