How West Virginia treats accrued PTO
West Virginia does not have a specific statute mandating PTO payout for all private employers. Whether PTO is paid out depends on the employer's established policy, agreement, or past practice. If the employer's policy promises payout, it must be honored. The WV Wage Payment and Collection Act requires employers to pay earned wages, which may include vacation if the employer's policy treats it as such.
