Does Wyoming require PTO payout?
Not automatically. Wyoming has no law forcing employers to pay out unused PTO, so it comes down to your written policy or contract. If the policy promises payout, that promise is enforceable as wages. The controlling authority is Wyo. Stat. § 27-4-104.

How Wyoming treats accrued PTO
Wyoming does not mandate PTO payout by statute. Whether unused vacation is paid depends on the employer's policy or employment contract. If the employer has a policy promising payout, it may be enforceable as wages. Important: Without a written forfeiture policy acknowledged by the employee, accrued vacation is generally treated as earned wages. Wyoming requires forfeiture policies to be (1) in writing and (2) signed/acknowledged by the employee.
